Surrogacy, parentage and donor conception
Gestational surrogacy: Statutory framework permitting and regulating gestational surrogacy
Idaho's Gestational Agreements Act (Idaho Code Title 7, Chapter 16, enacted 2023) requires a written agreement between the carrier and intended parents before assisted reproduction, requires a married carrier's spouse to join, and prevents the carrier or their spouse contributing gametes.
Parentage: The Act provides for validation of the agreement and for parentage to follow from it. Confirm the precise order timing with an Idaho reproductive-law attorney for your own arrangement.
Embryos: Following the Alabama decision in 2024, Idaho enacted House Bill 737, adding provisions to the Idaho Code concerning in vitro fertilisation. Separate fetal-personhood proposals have been raised in Idaho but were not enacted, and should not be treated as current law.
