A donor-conceived person is someone born as a result of fertility treatment using donor eggs, donor sperm or a donor embryo. Under the ART (Regulation) Act, 2021, a donor-conceived child's legal parents are the intending parent(s) who underwent treatment, not the gamete donor, and the donor has no parental rights or obligations towards the child. Because India's framework treats donor identity as confidential rather than providing donor-conceived people a legal right to identifying donor information later in life, families are encouraged to consider counselling support around disclosure decisions rather than assuming identifying information will later become available.
