Surrogacy is an arrangement in which a woman (the surrogate) carries and delivers a child for an intending or commissioning couple. In India, surrogacy is regulated by the Surrogacy (Regulation) Act, 2021 and its Rules, which permit only altruistic gestational surrogacy under specified conditions, carried out at a registered surrogacy clinic. Commercial surrogacy — paying a surrogate beyond permitted medical expenses and insurance — is prohibited in India.
