Sex determination — finding out the sex of a foetus — and sex selection — choosing the sex of a child before conception or during pregnancy — are both prohibited in India. Sex determination is banned under the Pre-Conception and Pre-Natal Diagnostic Techniques (PCPNDT) Act, and sex selection is separately prohibited under the ART (Regulation) Act, 2021 and the Surrogacy (Regulation) Act, 2021. No clinic, laboratory or individual may lawfully tell a patient the sex of an embryo, foetus or future child, or select gametes or embryos on that basis, for social reasons.
